Swimmer Turner Appeals Sex-Assault Conviction

Brock Turner the former Stanford swimmer convicted of sexually assaulting an unconscious woman leaves the Santa Clara County Jail in San Jose California

Brock Turner, 22, was convicted in March past year of sexually assaulting the woman after they drank heavily at a fraternity party at the university campus in California in January 2015.

Now his lawyers are hoping to overturn his mandatory lifetime requirement to register as a sex offender, describing the initial trial as "a detailed and lengthy set of lies".

Santa Clara County District Attorney Jeff Rosen told the Mercury News on Friday that Turner "received a fair trial and was justly convicted".

Brock Turner has appealed to have his sexual assault conviction overturned.

Lawyers for Brock Turner filed an appeal in California, saying their client was denied due process during his 2016 trial and calling it "fundamentally unfair".

'His conviction will be upheld. "Nothing can ever roll back Emily Doe's legacy of raising the world's awareness about sexual assault".

Buzzfeed has obtained a copy of the motion, and say that Turner's lawyers are arguing that the jury was not supplied sufficient evidence of Turner's character.

The former Stanford University swimmer was arrested in 2015, aged 19, after he was seen on top of an unconscious woman outside a fraternity house during party.

Key to Turner's request for a new trial is a statement the prosecutor repeatedly made during trial, saying the assault occurred "behind the dumpster". Jerry Brown a year ago that added mandatory-minimum prison sentences for sexual assaults and expanded the definition of rape to include digital penetration would not apply because they were not in effect when the crime occurred. Turner ended up serving just three months before he was released.

Stanford law professor Michele Dauber, who is on a committee to recall the judge who sentenced Turner, said it's common for people to appeal.

The case received worldwide attention after Turner's victim delivered a heartbreaking 12-page statement detailing her experience. "It's not appropriate for the court of appeals to step in and retry those facts".
