In the New York Times story, O'Reilly said he paid Bernstein and other women who complained because he's "vulnerable to lawsuits from individuals who want me to pay them to avoid negative publicity".

Rachel Witlieb Bernstein's attorneys filed a lawsuit Monday in U.S. District Court for the Southern District of NY against O'Reilly and his former employer, Fox News, for breach of contract and defamation. In a suit filed Monday, she accused him of defamation and breach of contract over comments he has publicly made about the allegations.

"O'Reilly depicted Ms. Bernstein in a false light, criticized and derided her character, raising doubt about her intentions in detailing O'Reilly's manhandle to HR and at last being constrained out at Fox News with a settlement assention", she asserts in her suit.

The complaint, filed in NY federal court, also addresses statements from Fox News this past April. She said she talked repeatedly to bosses about O'Reilly's actions, but there was no hotline in place at the time of the incidents.

A woman who settled with television host Bill O'Reilly is now leveling a new lawsuit against him and Fox News. Shortly thereafter, the woman, Rachel Witlieb Bernstein, left the network with a payout and bound by a confidentiality agreement, people familiar with the deal said. According to Bernstein's lawsuit, there was no hotline at the time, and she in fact told others at the network about the mistreatment.

According to the suit, the settlement agreement provided that the parties would not disparage each other and that, if asked, the parties would say that "the matter has been resolved". The exact amount she was paid is not known, but it was far less than the other settlements.

The plaintiff said she was not the source for the information printed in the Times story.

O'Reilly and spokesman Mark Fabiani did not immediately respond to a Law&Crime request for comment.

"He's gone far beyond that and painted our client in a bad light", lawyer Neil Mullin told WaPo, claiming that O'Reilly violated the 2002 settlement case by implying that Bernstein's claims were politically motivated, Variety reported.

The lawsuit says Bernstein has suffered loss of income, emotional distress and sickness.
