Interim fighter aftermath - US Commerce Dept. upholds duties against Bombardier

"The C Series would not even exist at this point but for those subsidies", Boeing said, adding that the support enabled the company "to dump aircraft into the USA market at absurdly low prices".

Ross ruled Canada-based Bombardier received government subsidies and sold its C-Series jets below cost price in the USA, a step likely to lead to tariffs of more than 200 per cent on the plane.

Boeing, which launched the trade case in April, is arguing that Canadian and British governments are subsidizing the plane's cost, allowing Bombardier to sell into the US market at unfairly low prices.

As a result, the commerce department determined that exporters from Canada sold 100- to 150-seat large civil aircraft in the United States at 79.82 percent less than fair value.

"The United States is committed to a free, fair and reciprocal trade and will always stand up for American workers and companies being harmed by unfair imports", Ross said.

The plan would create a new wrinkle because the planes would effectively be a US product."There's no case here", Bombardier's Bellemare said, calling the complaint "ridiculous". The complaint found a receptive ear in President Donald Trump, whose "America First" agenda has included taking a tough line in matters of worldwide commerce.

Lindsey Fussell, Ofcom's consumer group director, said the new rules would stop companies from "delaying and frustrating" the process.

Labelling Boeing's complaint "meritless" and a "cover to close the US market", Mr Turner called on the US International Trade Commission (ITC) to set aside the Commerce Department's decision when it hears the next stage of the complaint in February.

The inquiry now moves to the United States global trade commission, which will examine if the dumping and subsidies caused injury to Boeing.

"Unfortunately, the Commerce Department decision is divorced from this reality and ignores long-standing business practices in the aerospace industry, including launch pricing and the financing of multi-billion dollar aircraft programs", said Mike Nadolski, Bombardier's vice president of communications and public affairs. Bombardier and Boeing argued their cases Monday before the ITC, an independent, quasi-judicial US agency.

The Chicago-based aircraft manufacturing giant said the final duty determination validates its complaint.

Bombardier argues that they wouldn't since Boeing does not make an aircraft the size of the 100- to 130-seat CS 100. But the panel also appeared dubious about Bombardier's claims that the CSeries and the smallest versions of the 737 do not compete against each other at all.

In October, shortly after the preliminary tariffs were announced, Boeing archrival Airbus took a majority stake in the C-Series program, announcing that the planes would be built at the Airbus plant in Mobile, Alabama.
