Cong opposes criminalisation part of triple talaq bill, says Sibal

Rajya Sabha adjourned till 4th January, 11 am after tug and war between BJP and Congress over Triple Talaq Bill.

But the government did not yield and insisted on passing the bill without amendements as was done in the Lok Sabha when the Lower House passed it last Thursday. But his position, as reflected by his party's stand on the key Bill, may put him in same spot from where he had began in the run up to Gujarat elections. The Supreme Court's decision banning instant triple talaq was a positive step in this direction. The Board announced to set up counselling centres for Muslim couples to impart them knowledge about Triple Talaq from an Islamic point of view.

On August 22 a year ago, the Supreme Court banned the practice of instant triple talaq, (the practice under which a Muslim man can divorce his wife by simply uttering the word "talaq" three times) calling it unconstitutional. The panel of five judges represent different faiths - Hinduism, Christianity, Islam, Sikhism and Zoroastrianism. In case of pronouncement of triple talaq instantly, this essence of repeating the practice three times is lost. The Congress has traditionally been seen as a supporter of conservative Muslim religious leadership; for its new image, to gain confidence of the Hindus, it needs to be seen as taking a distance from issues concerning the Muslim community. This bill, brought by the BJP government, is a defective one.

"To uplift Muslims, you (government) should instead focus on their education and employment; they will naturally incline towards you", he said. But politics is a fierce battle and the story begins here.

Azad said the BJP is projecting itself as a "messiah" for muslim women and claiming to be champions of their welfare and rights, but has not made any provision for their welfare.

Prasad said "the practice continues" even after the Triple Talaq Bill was passed in the Lok Sabha and cited an alleged case of a woman in Moradabad who was divorced instantly over dowry. The Opposition parties hold a majority in the Upper House.

Jaitley further explained why the government can not send the bill to a Standing Committee saying, "Reason why it should not be referred (to select committee) is that when the practice was declared unconstitutional, two of the judges held it as unfair and used their extraordinary power to suspend it for six months, which expire on February 22".

In a meeting with Rajya Sabha chairperson Venkaiah Naidu, the Congress, AIADMK, DMK, CPI, CPI (M) and BJD said the bill should be referred to a select committee for detailed discussion.

Jaitley objected to the motion saying the opposition had "sprung a surprise" by suddenly moving this amendment without giving a proper notice at least 24 hours in advance as required by the rules. "For the first time breaking all parliamentary convention and procedures, an invalid motion is moved" he added. But it will find its place in the statute book only after it has been passed by the Rajya Sabha, then received presidential assent and ultimately notified in the official gazette stating the date on which it will become effective. The government created disruptions in the Rajya Sabha. It is being criticized for ignoring the sustenance of a woman whose husband pronounced triple talaq and went to jail for three years.

Muslim women whose husbands have pronounced instant and arbitrary triple talaq upon them are not an exception.
