Lindsay Lohan's Lawsuit Battle With GTA V Creator Take-Two Ends

Lohan had accused Take-Two of violating her privacy rights by using her likeness for a character in Grand Theft Auto V.

In a case dating back to 2014, Lohan, 31, had claimed Take-Two's look-and-sound-alike character had represented an invasion of her privacy.

The court upheld a ruling from a lower state appeals court, which dismissed her lawsuit.

Lohan said that Lacey Jonas' character was blonde, wore a red bikini, and famously threw up a peace sign, and Lohan said it was clear that the game had misappropriated her "portrait", "voice", and "persona".

The judge ruled that the satirical representations of "a modern, beach-going" young woman are not enough to link with Lohan.

In addition to shooting down her lawsuit, the Court of Appeals also ordered Lohan to pay Rockstar's court costs.

The character was featured in various marketing materials leading up to the release of Grand Theft Auto V in September of 2013 and was portrayed as a troubled Hollywood star who is constantly harassed by paparazzi.

In simpler terms, Lacey Jonas is not a likeness of Lohan, and that's the final word.

In March a NY judge allowed the case to move forward but in September, the case was thrown out of court. In the Grand Theft Auto game makers' dismissal, they stated that she had a history of "misusing the legal system". Another pre-game intro sequence also sported the woman being handcuffed by a police officer. Lohan's lawyers filed an appeal soon after. In preparation for this appeal, numerous media organizations asked the court to reject the case in order to protect the First Amendment and artists' rights to create parodies or works loosely based on real people, according to Rolling Stone. It is undisputed that defendants did not refer to plaintiff in GTAV, did not use her name in GTAV, and did not use a photograph of her in that game.

In a separate order, the court dismissed similar claims against Take-Two by Karen Gravano, a star of the reality TV series "Mob Wives", over another character.
