Judge James Donato, a federal judge in San Francisco, dismissed Facebook's argument that the law didn't apply to it because its servers aren't located in the state.

Facebook has issued a statement saying it continues to believe the case has no merit, and that it will continue to fight it "vigorously". The company also tried and failed to claim that the data it collects isn't covered by BIPA, which restricts the collection of fingerprints, voice prints, and "hand or face geometry". Donato in February rejected Facebook's bid to dismiss the suit, finding BIPA left "little question that the IL legislature codified a right of privacy in personal biometric information".

In June 2011, Facebook introduced a feature in certain countries - the USA being one of them - giving users the ability to automatically tag people in their photographs.

Mark Zuckerberg's Facebook faces a class action suit in California over facial recognition.

The class action will consist of users in IL "for whom Facebook created and stored a face template after June 7, 2011", he said.
