Judge Loya won't be forgotten’ Rahul Gandhi tweets

Union minister Prakash Javadekar on Thursday rubbished Congress' questions relating to the Supreme Court verdict rejecting a batch of pleas seeking a probe into the alleged mysterious death of judge BH Loya.

A bench of Chief Justice Dipak Misra and justices A M Khanwilkar and D Y Chandrachud said the conduct of the petitioners and the intervenors scandalised the process of the court and prima facie constituted criminal contempt. The investigation was done professionally by the Nagpur Police and all the evidence was presented in court, he said.

Bhushan defended CPIL, which he said "got involved in the judge Loya case after seeing the case reports". Several other appeals were made to the Supreme Court for the same. The court wondered how the senior lawyers made such callous and unverified allegations and felt it necessary to protect judges of the district judiciary and stood by their statements realising how vulnerable they are to "wanton attacks" on their independence.

He also stressed that the Congress was not among the petitioners seeking a probe into the judge's death and recalled that the party had instead approached the people's court and approached President Ram Nath Kovind along with 14 other opposition parties.

His death raised questions from certain quarters about the possibility of a foul play. The conclusion of the discreet inquiry is that Judge Loya suffered a heart attack in the presence of his colleagues belonging to the judicial fraternity.

The issue of Loya's death had come under spotlight in November past year after media reports quoting his sister fuelled suspicion about the circumstances surrounding it and its link to the Sohrabuddin case. Justice Loya was hearing the Sohrabuddin Sheikh fake encounter case, involving various police officers and Bharatiya Janata Party (BJP) chief Amit Shah, before his death in December 2014.
