Golden State Killer suspect fights DNA assortment effort

Judge rules suspected Golden State Killer must be photographed fully NAKED - including his penis - and submit to additional DNA testing

DeAngelo, appearing in court in an orange jumpsuit and handcuffed to a wheelchair, said nothing.

But Superior Court Judge Michael Sweet sided with the district attorney and said that courts have repeatedly allowed the collection of such evidence because it's not a form of testimony and would not harm DeAngelo's right against self-incrimination.

DeAngelo, a former police officer, Vietnam veteran and a mechanic, was a reclusive neighbor in Citrus Heights, a town about 16 miles northeast of the California capital, according to residents.

'There's no basis to stop the execution of the search warrant, ' he said. He is accused of being the criminal known as the Golden State Killer or East Area Rapist, who terrorized California in the 1970s and '80s.

Prosecutors arrested DeAngelo last week and said they used DNA to identify him as the killer responsible for at least a dozen murders and 50 rapes across California between 1976 and 1986. He has not yet entered a plea.

Neighbors have said DeAngelo mostly kept to himself and sometimes yelled at people who got too close to his fence, but they said he had become a recluse in recent years.

Prosecutors said they used DNA and a public genealogical online database to identify DeAngelo, decades after the case had gone cold. On Sunday, the US government will open nationwide enrollment for an ambitious experiment: If they can build a large enough database comparing the genetics, lifestyles and environments of people from all walks of life, researchers hope to learn why some escape illness and others don't, and better customize ways to prevent and treat disease.

Court records show authorities had planned to take photos of DeAngelo's entire body, including his penis, and collect DNA on Wednesday before his attorney, Diane Howard, objected.

They argued that a search warrant that prosecutors sought for law enforcement had been granted before DeAngelo was arrested and given a public defender, and thus void. A hearing is scheduled for May 14.
