Trump Administration to Deny Visas to Same-Sex Partners of Diplomats, U.N. Officials

The Trump administration continues their attack on LGBTQ rights in a new directive leveled at the same-sex domestic partners of diplomats and United Nations employees.

Foreign Policy magazine, which first reported the story, estimated that there are at least 10 current United Nations employees who would need to get married in order to get their partners' visas renewed. On Monday, it implemented a policy denying visas to such partners if they're not legally married.

Only if a same-sex couple is married will the spouse be eligible for a visa, but that could prove problematic for some, as the majority of the world's countries do not recognize same-sex marriages.

But critics says the new policy will impose undue hardships on foreign couples from countries that criminalize same-sex marriages.

The Trump administration policy is an example of evolving practices since the Supreme Court ruled in 2015 that same-sex marriage is a constitutional right. One Nigerian man (not a United Nations staffer) who married his same-sex partner overseas reported that both he and his family members in Nigeria received death threats as a result. Tunisia, Cameroon, Tanzania, Indonesia, Uganda, and Russian Federation have arrested people for same-sex conduct.

"Needlessly cruel & bigoted", former ambassador to the UN Samantha Power said on Twitter.

The officials also noted that the requirement would align the policy of the one that applies to U.S. diplomats overseas.

It was detailed in a memo circulated to employees at the United Nations' headquarters in NY last month.

Heterosexual domestic partners of foreign diplomats are also not eligible for US visas, a State Department spokesperson explained, and the new policy would "ensure and promote equal treatment", according to ABC News.

The change went into effect on Monday, giving partners now in the U.S. until 31 December to leave, get married or otherwise change their visa. Instead, same-sex partners of diplomats based in the United States will have to present proof of marriage to be eligible for such visas.

The memo on the policy change, dated July 12, updates an earlier diplomatic note concerning the definition of family members.

However, it is a departure from a former Secretary of State Hillary Clinton's policy to allow extend benefits to same-sex domestic partners of diplomats who are not married.

Akshaya Kumar, the Deputy UN Director of Human Rights Watch, wrote that the change "will have an insidious impact on same-sex couples". This presents a variety of problems, especially for diplomats who hail from countries where same-sex marriage and homosexuality is illegal, unnecessarily jeopardizing their safety.

"It is an unfortunate change in rules, since same-sex couples, unlike opposite-sex couples, have limited choices when it comes to marriage", U.N. Globe, a group that advocates for LGBT staff at the U.N., said in a statement released before the change.

Currently, only 26 countries have legalized same-sex marriages, the Pew Research Center noted.
